New Jersey Under-Ride Collision Attorneys
Under-Ride Accident
There are many obstacles that motorists in New Jersey have to be careful of while driving a vehicle. Pedestrians, other vehicles (both mobile and stationary), and wildlife all force the motorist to pay constant attention to the road. However, sometimes other drivers, particularly those drivers or large cargo trucks, or big rigs, don't take other drivers into account, and New Jersey under-ride collisions are the result.
Under-ride collision occurs from negligence. In the battle of a large truck versus passenger car, a large truck certainly almost always wins. Often resulting in death, New Jersey under-ride collisions are caused by a number of reasons.
The two main types of under-ride collision in New Jersey are side collision and rear collision.
- Side collision accidents occur when a large truck is attempting to change lanes, make a turn of some kind, or cross an intersection when visibility is obscured. A passenger car, often in the truck driver's blind-spot, collides with the side of the truck's trailer, lodging itself underneath the truck's load and often resulting in serious injury or death to the driver of the passenger car.
- Rear collisions are similar in that obscured trucks are not seen by a driver until it is too late. The driver of the passenger car collides head-first with the back of the truck's trailer, becoming wedged underneath it. Accidents such as these are often times fatal, but rarely for the truck driver, who often does not even realize that a smaller vehicle is lodged underneath the truck's trailer.
Negligence can play a big part in under-side collisions. During nighttime especially, trucks that have not been properly maintained, in particular those trucks whose taillights are burned out or lack side reflectors, pose a serious threat to fast approaching vehicles with drivers who are unaware of any moving objects in their path. In addition, poor brakes can also lead to New Jersey under-side collisions. If a large truck suddenly hits its brakes hard, unsuspecting drivers traveling behind that truck may not be able to stop in time to prevent a collision.
Furthermore, if lanes are neither adequately marked nor easily visible, particularly during nighttime driving, unsuspecting truck drivers may waiver into nearby traffic, further posing the risk of under-ride collision. Truck drivers have large blind spots. Motorists of smaller cars are not always in plain view of truck drivers, and therefore are extremely vulnerable to side collision accidents where traffic lanes are not visibly marked.
